TERMS OF SERVICE

⚠ IMPORTANT: By using PM::OFFSEC, you confirm that you have explicit written authorization to scan any systems, networks or devices you submit. Unauthorized scanning is a federal crime under the Computer Fraud and Abuse Act (18 U.S.C. § 1030). We enforce this strictly.

1. ACCEPTANCE OF TERMS

By accessing or using PM::OFFSEC Security Dashboard ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including free accounts, paid subscribers, and API users.

2. AUTHORIZED USE ONLY

YOU MUST HAVE EXPLICIT AUTHORIZATION to scan any system. This means:

Scanning systems without authorization is illegal. We will cooperate fully with law enforcement investigations and will terminate accounts involved in unauthorized scanning immediately and without refund.

6. DATA OWNERSHIP

Your scan data belongs to you. You can export all your data at any time from your dashboard. PM::OFFSEC does not claim ownership over your infrastructure data or scan results. We may use anonymized, aggregated statistics (never individually identifiable) to improve the service.

7. SERVICE AVAILABILITY

We target 99% uptime but do not provide an SLA for Free or Starter plan accounts. Enterprise accounts receive priority support and a 99.5% uptime commitment. Scheduled maintenance will be announced at least 24 hours in advance.

We are not liable for data loss caused by service interruptions. You are responsible for maintaining your own backups of critical scan data.

8. LIMITATION OF LIABILITY

PM::OFFSEC is a security scanning tool. It identifies potential vulnerabilities but does not guarantee that your systems are completely secure. Our tool may:

To the maximum extent permitted by law, PM::OFFSEC is not liable for any security breaches, data loss, or damages resulting from: (a) vulnerabilities not detected by our tool, (b) misuse of scan results, or (c) failure to implement recommended remediations.

Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

9. INTELLECTUAL PROPERTY

PM::OFFSEC, its branding, dashboard design, and proprietary scanning algorithms are owned by Prakash Mijar. You may not copy, redistribute, or create derivative works from our platform without written permission.

You retain all rights to your own scan data and any content you upload to the platform.

10. TERMINATION

We may suspend or terminate accounts that:

You may cancel your account at any time from your account settings. Upon cancellation, paid access continues until the end of the current billing period.

11. GOVERNING LAW

These terms are governed by the laws of the United States. Disputes will be resolved in the applicable US courts. For users in the European Union and Nepal, GDPR rights apply as described in our Privacy Policy.

12. CHANGES TO TERMS

We will notify registered users by email at least 14 days before any material changes. Continued use after changes constitutes acceptance of the updated terms.
